AN ACT TO REQUIRE BOARDS OF SUPERVISORS TO PAY A SALARY TO PERSONS APPOINTED TO SERVE AS AN INTERIM CHANCERY OR CIRCUIT CLERK; TO PROHIBIT INTERIM CHANCERY AND CIRCUIT CLERKS FROM RETAINING FEES AS COMPENSATION FOR THEIR SERVICES; TO REQUIRE CERTAIN FEES COLLECTED BY INTERIM CHANCERY AND CIRCUIT CLERKS TO BE DEPOSITED INTO THE COUNTY GENERAL FUND; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. Whenever a person is appointed by the board of supervisors to fill a vacancy in the office of chancery clerk or circuit clerk, the board of supervisors shall pay a salary in an amount not to exceed One Thousand Dollars ($1,000.00) per week to the person so appointed until his successor is elected and takes office. A person appointed to serve as chancery clerk or circuit clerk may not retain any fees collected by the chancery or circuit clerk's office as compensation for his services. All fees collected by the office of the chancery clerk or circuit clerk, other than those fees used to pay the salaries and expenses of employees of the chancery or circuit clerk and those fees that are to be held by the chancery or circuit clerk in a trust or custodial capacity, as prescribed under Section 9-1-43, shall be deposited into the county general fund.

SECTION 2. This act shall take effect and be in force from and after October 1, 1999.
